Could IVA advice have saved family's home?

A Plymouth family could be wishing their landlord had sought individual voluntary arrangement (IVA) advice after being told they are to be evicted.

The BBC reports the situation faced by the Hempsons, who moved into their new rental home in March of this year.

However, while they have continued to pay their rent on time, their landlord is alleged to have failed to meet his own repayments on the mortgage on the property.

While an IVA cannot be used to tackle mortgage debts directly, IVA advice on other debts he may have had could have enabled funds to be diverted towards servicing the loan secured on the property.

In turn, this may have permitted the Hempsons to remain in what has become their family home.

However, they now face eviction, despite offering to pay their rent directly to the mortgage provider, as it is against the financial services provider’s company policies to do so rather than to directly repossess the home.
